Hirebird Purchase Policy Agreement

 

This Purchase Policy Agreement ("Agreement") governs the terms and conditions of all purchases made by customers ("You" or "Customer") through the Hirebird platform ("Hirebird" or "We" or "Us"). By purchasing goods or services from Hirebird, You agree to the terms outlined in this Agreement.

1. Scope of Goods and Services

Hirebird provides various goods and services, including but not limited to:

  • Credit usage for services.

  • Staffing services (permanent, temporary, and contract-based).

  • Extended arm software development (remote and on-site teams).

  • Any other goods or services made available for purchase through the Hirebird platform.

2. Purchase Process

2.1 Orders and Confirmation

  • All orders for goods and services are processed through Hirebird's online platform.

  • An order is only considered confirmed when You receive a formal acknowledgment from Hirebird via email or through Your Hirebird account.

  • We reserve the right to cancel or refuse any order for reasons including, but not limited to, product or service unavailability, pricing errors, or suspected fraudulent activity.

2.2 Pricing

  • All prices displayed on the Hirebird platform are in [Insert Currency] and are subject to change without notice.

  • Pricing for services like credit usage, staffing, and software development projects may vary based on scope, timelines, and other factors outlined in individual service agreements.

  • Any applicable taxes, duties, and fees are in addition to the listed prices and are the Customer’s responsibility.

2.3 Payment Terms

  • Payment is required at the time of purchase unless otherwise agreed upon in a service agreement.

  • Hirebird accepts payment via the following methods:

    • Credit card or debit card.

    • Wire transfer.

    • Individual invoice or quote (subject to approval by Hirebird for specific projects or larger purchases). Invoices will be issued directly to the Customer and must be paid within the agreed payment terms.

  • In cases where credit is offered as a form of payment (e.g., through promotional credits or prepaid service credits), such credits must be used before their expiration date, as specified in the credit terms.

3. No Refund Policy

All sales are final.

3.1 No Refunds

  • Purchases of goods, services, and credits through Hirebird are non-refundable, regardless of the reason for cancellation or non-use.

  • Once a payment has been processed and the service or good has been delivered or initiated, no refunds will be issued under any circumstances.

3.2 Credit Conversion

  • In the event a service is canceled, delayed, or not fully utilized, You may request the value of the unused portion of the purchase to be converted into Hirebird credits, subject to Hirebird’s approval.

  • These credits can be used toward future purchases of any goods or services offered by Hirebird.

  • Credits cannot be transferred to other accounts, and they expire according to the terms provided at the time of issuance. Expired credits are not refundable or extendable.

4. Credit Usage

4.1 Purchase and Application of Credits

  • Credits may be purchased or received as part of certain promotions and applied toward services available on Hirebird’s platform.

  • Credits are non-refundable, non-transferable, and must be used within the timeframe specified at the time of purchase or issuance.

  • Credits can be applied toward the purchase of staffing services, extended arm software development, or other eligible goods and services.

5. Staffing Services

5.1 Service Delivery

  • Hirebird offers a range of staffing services, including permanent placement, temporary staffing, and contract-based personnel.

  • The terms of the staffing services, including rates, job roles, and duration, will be outlined in a separate service agreement between You and Hirebird.

5.2 Replacement Guarantee

  • For permanent and contract staffing, Hirebird may offer a replacement guarantee in the event a placed candidate is terminated or voluntarily leaves within the first [Insert Number] days of employment. Specific conditions apply and will be detailed in the service agreement.

5.3 Liability

  • Hirebird does not assume responsibility for the actions, negligence, or performance of the candidates or contractors placed at Your organization. The Customer is responsible for day-to-day management and supervision of hired personnel.

6. Extended Arm Software Development

6.1 Service Scope

  • Extended arm software development services are provided by remote or on-site development teams, as per the agreed-upon project scope, timelines, and deliverables.

  • All project terms, including milestones, intellectual property rights, and service fees, will be specified in a separate service contract between You and Hirebird.

6.2 Changes to Scope

  • Any changes to the project scope after the initial agreement will require mutual consent and may result in additional costs.

6.3 Confidentiality and Intellectual Property

  • All software code, documentation, and deliverables produced as part of the extended arm software development services shall be considered confidential and are governed by the terms of the service agreement.

7. Cancellation and Refund Policy

7.1 No Refunds on Services

  • As mentioned in Section 3, there are no refunds for services rendered or goods purchased. If applicable, a credit may be issued based on the unused portion of the service or purchase and subject to Hirebird’s discretion.

7.2 Credit Transfers

  • Any refunds for canceled services or unused portions of service agreements will be transferred into credits, which can be used for future purchases on Hirebird’s platform.

  • These credits are not refundable or redeemable for cash and must be used within the specified period.

8. Dispute Resolution

In the event of any dispute arising from the purchase or use of Hirebird’s goods and services, both parties agree to attempt to resolve the issue amicably through informal negotiation. If an amicable resolution is not possible, disputes will be settled through arbitration in accordance with [Insert Country/State] law.

9. Limitation of Liability

To the fullest extent permitted by law, Hirebird’s liability for any claim arising from or in connection with any purchase made under this Agreement shall be limited to the amount paid by You for the specific goods or services at issue.
